This policy guide outlines the procedures for Requesting a Change of Order pursuant to WIC 385.

This policy guide was revised from its 7/01/2014 version to update and streamline procedures regarding removing a child from parents, legal guardians, or caregivers, requesting a more restrictive visitation/family time order, and to add references to the placement preservation process.  The title was also changed from "WIC 385: Requesting a Change in Order."

POLICY

Welfare and Institutions Code Section (WIC) 385

Any order made by the court (related to a person subject to its jurisdiction) may at any time be changed, modified, or set aside, as the judge deems necessary for the protection and safety of a child, per WIC 385. A petition filed pursuant to WIC 385 is referred to as a "Request for Change of Order Pursuant to WIC 385" and is submitted by Intake and Detention Control (IDC) via an Ex Parte Application and Order.

A Request for Change of Order may be required in any of the following situations:

  • In a pre-disposition case: A Children’s Social Worker (CSW) has detained or is requesting the court to order detention of a child from the care of their parent(s) or legal guardian(s) when the court’s pre-disposition order fails to adequately protect the child.
    • In a post-disposition case: To detain a child from a parent/legal guardian, a WIC 387 or WIC 342 petition may be needed.

  • A CSW is requesting a court order to remove a child from the care of any caregiver as an exemption from the placement preservation and notice process. This may include pre- or post- disposition requests to remove a child from a relative or nonrelated extended family member (NREFM) when the court has ordered the child placed with that specific family member/NREFM.
    • In a pre-disposition case: CSWs should file a WIC 385 request with IDC to address these detention/placement issues. 
    • In a post-disposition case: When court has ordered a child placed with a specific family member, or a child is going from a less restrictive to a more restrictive placement, CSWs should file a WIC 387 petition.

  • To request a more restrictive visitation/family time order (pre- or post- disposition)
    • If visitation/family time issues are emergent and a visit is soon to take place, CSWs should submit a WIC 385 petition request via the IDC Petition Filing Tracking System so the matter can be calendared for a next-day hearing. (The WIC 385 submission deadline is 12pm daily).
      • Further, if this request for a change in visitation is to be permanent, a WIC 388 petition may need to be filed with Court Liaison instead of, or in addition to, a WIC 385 request.
    • If visitation/family time issues are not emergent, a WIC 388 may be filed with Court Liaison for a permanent change to the order.
    • CSWs are encouraged to consult with the assigned trial or outstationed County Counsel prior to filing petitions for these requests.

Ex Parte Application and Order

To request a change of order, an Ex Parte Application and Order Pursuant to WIC 385 must be completed and submitted to court by IDC. The following chart outlines the CSW responsible for completing the Ex Parte Application and Order based on the case status.

PROCEDURE

Submitting a Request for a Change of Order

CSW/DI Responsibilities

  1. Review and, if necessary, update the online case record to ensure that all identifying information (e.g., names, addresses, etc.) and court information (e.g., past hearing dates, notices of hearing, attorneys’ names, etc.) are documented and current.
  2. Create an Intake Referral Request in the IDC Petition Filing Tracking System (located on LAKids/Web Applications) and enter all necessary information, including the child’s current placement. 
  3. Generate and complete the Ex Parte Application and Order on CWS/CMS.
    1. Select the recommendations that correspond to the child’s assessment, evaluation, situation and best interest of the child.
    2. Clearly indicate the change of order being requested from the court.
    3. If ARA or higher approval and assessment is necessary, such as when placing any child in a group home or placing a child under age twelve (12) in a Short-Term Residential Therapeutic Program (STRTP), create additional signature lines as needed.
  4. If applicable, complete the necessary paperwork and submit the recall for any protective custody warrants.
  5. Submit for online CWS/CMS approval, print and sign the completed report, and submit the hard copy report to the SCSW for signature.
    • If the report is not approved, take necessary corrective action and return to SCSW for approval.
    • Upon receipt of the approved report, submit the report and any supporting documents  to IDC.
  6. Document all contacts in the Contact Notebook.
  7. Notify the child’s parents(s) or legal guardian(s) and attorney of the child’s placement or proposed visitation/family time restriction as soon as possible, but no later than one (1) business day of the action taken.
  8. If the case is pre-disposition, notify any other assigned CSW and provide them with the hearing date.

IDC Dependency Investigation Assistant (DIA) Responsibilities

  1. Calendar the case.
  2. Provide the regional CSW/DI with the date of the scheduled hearing.
  3. Request that the Ex Parte Application and Order (WIC 385 Petition) and supporting documents be sent to IDC via the IDC Petition Filing Tracking System.

Continuing Services (CS) or DI SCSW Responsibilities

  1. Review the report and any supporting documents to ensure that the new placement or visitation/family time request is in the best interest of the child.
  2. If approved and ARA or higher approval is necessary, forward the report to the ARA for signature.
    • Once all approvals are received, approve the report online and return the packet to the CSW.
  3. If not approved, request corrective action and return the packet to the CSW.

ARA Responsibilities

  1. Review report for appropriateness.
  2. If approved, sign and date the report and return to the SCSW for online approval.
    • If not approved, return the packet to the SCSW for corrective action.

Welfare and Institutions Code (WIC) Section 385 – Any order made by the court in the case of any person subject to its jurisdiction may at any time be changed, modified, or set aside, as the judge deems necessary, subject to procedural requirements.

WIC Section 16010.7 - Prior to a caregiver or provider requesting a child or youth to be removed from the caregiver’s or provider’s care, the caregiver or provider shall participate in a placement preservation strategy meeting.
