This policy guide was updated from the 10/18/12 version, as part of the Eligibility Policy Redesign.  It was revised to include all matters related to the Infant Supplement in one place.  Also, the title of the policy has been revised.  The former title of this policy was “Teen Parents in Foster Care”.

POLICY

Placement and Services

This policy applies to teen and NMD parents who are under the supervision of the Department of Children and Family Services (DCFS).  It also applies to their infant child(ren) who may or may not be a dependent of the Court and whom the teen or NMD parent may or may not have custody of.  

This policy addresses:

Assignment of Case Name and Case Number

If the infant is not a dependent, the case name and the case number of the dependent will be the same.

If the infant is a dependent, the case name is that of the infant and a separate case number is assigned.

If the infant is removed from the dependent parent and placed in a separate foster care placement, the infant’s eligibility for foster care must be determined based on the dependent parent’s circumstances.

Certified Whole Family Foster Home (WFFH)

A resource parent who has received specialized training and is certified as a WFFH provider.  This is not a new license type.  It includes both new and existing FFH, and the homes of non-related legal guardians (NRLG) (granted through dependency court, not probate court) who are appropriately recruited and trained. The Infant Supplement Rate for a Certified WFFH caregiver is the same as for all Resource Family (RF) approved homes. The benefit of utilizing a Certified WFFH for a dependent parent with a non-dependent child, is that the caregiver has received specialized education/training to work with a parenting youth. In addition, the WFFH caregiver is eligible to receive an additional monthly stipend if the WFFH caregiver completes a Shared Responsibility Plan (SRP) with the dependent parent, which is then approved by the Case-Carrying CSW and SCSW.

Dependent Infant Placed with Their Dependent Parent in a WFFH

Dependent infants may be placed in a WFFH with their dependent teen or NMD parent.

Expectant Parent Payment (EPP)

This does not require any TA/EW tasks.  The Expectant Parent Payment (EPP) is detailed in FYI 22-03, Expectant Parent Payment. 

Group Home/Short Term Residential Therapeutic Program (STRTP) Infant Supplement

The board and care rates received by a group home/STRTP for a dependent infant placed together with their dependent minor parent will be the standard group home/STRTP monthly infant supplement payment for the infant, and the appropriate group home/STRTP payment for the minor dependent parent, rather than two full foster care group home rate payments (one for each child).

Infant Supplement

The Infant Supplement is a specialized rate issued to caregivers for the provision of care to each non-dependent child residing with their dependent parent, placed in their home.

Nondependent Infant Residing with Their Dependent Parent

When court ordered reunification services are terminated (i.e., the child is returned home) for the dependent infant and the infant is no longer under the placement and care of the county welfare and/or probation department, the infant is no longer eligible for an AFDC-FC payment.  Therefore, a provider would only be entitled to the Infant Supplement amount, rather than two (2) Aid to Families with Dependent Children-Foster Care (AFDC-FC) payments.

Nonminor Dependent (NMD) Parent

A current dependent child (Extended Foster Care (EFC) or ward of the delinquency court (nonminor under the transition jurisdiction of the juvenile court), who: 1) has attained 18 years of age while under an order of foster care placement by the juvenile court; 2) is in foster care under the placement and care responsibility of the county welfare department, county probation department, Indian tribe, consortium of tribes, or tribal organization; 3) is participating in a transitional independent living case defined by WIC 11400(v); and 4) is a parent.

Parenting NMDs may also qualify for the following:
    • The infant supplement is available regardless of the type of placement the NMD is in.
    • The provider will receive the infant supplement if the parenting NMD is placed in a licensed/approved facility.
    • If in a SILP, the parenting NMD can receive the foster care payment and the infant supplement directly. 
    • May be placed in a WFFH, which can include the THP NMD host family site.

Nonminor Dependents and WFFHs

For more information refer to ACL 06-04 and ACL 08-24 regarding minor dependents and WFFH. (See also ACL 11-69, and ACL 11-77).

Parenting Support Plan (PSP)

The PSP is written for the express purpose of identifying additional support and assisting the NMD parent in providing the best care plan for their child.  The PSP must specifically outline the ways in which the adult mentor will assist the NMD parent with regard to the child in addition to identifying supportive services to be offered to the NMD parent.

In the instance when the NMD has more than one infant, in order to get the additional payment for each infant, there must be individual PSP(s) for each child.

PSP Rate

For NMD parents:  An additional $200 amount per month will be provided in addition to the infant supplement, if residing in a SILP, and after development and approval of a PSP with an identified responsible adult mentor.

If the NMD parent changes their adult mentor for any reason, a new PSP must be created.

CSWs should inform the youth of a PSP and it’s benefits.

The PSP must be reviewed and approved by the CSW and SCSW.  The CSW submits the approved PSP to the TA/EW to initiate the PSP rate. 

At a minimum, the adult mentor must meet the following criteria under WIC 16501.27:

  • Be at least 21 years of age
  • Undergo a criminal records check
  • Undergo a Child Abuse Central Index Check

In the instance when the NMD has more than one infant, in order to get the additional payment for each infant, there must be individual PSP(s) for each child.

Shared Responsibility Plan (SRP)

For youth placed in a WFFH, an SRP is an agreement between the dependent teen parent and their caregiver about the duties, rights and responsibilities each has with regard to the teen parent’s non-dependent child.

Per existing policy, CSWs are to attach the SRP to the Auto 280 and submit to the TA/EW when requesting the SRP Rate. Thereafter, every six (6) months, the CSW must submit an Auto 280 to the TA/EW with an updated SRP attached, authorizing continuation of the SRP Rate.  If this is not received timely by the TA/EW, then the payment will be discontinued.

SRP Rate

A $200/monthly financial incentive for WFFH caregivers who choose to develop a SRP with teen parents placed in their care.

Supervised Independent Living Placement (SILP)

A SILP is a supervised and approved placement that is part of the EFC program. A SILP is a flexible and least restrictive placement setting. It can include: an apartment (alone or with roommates); shared living situations; room and board arrangements; room rented from a landlord, friend or relative (including parents), or former caregiver; or, college dorms. NMDs living in a SILP may have their dependent or non dependent children with them. NMDs residing in SILPs with their children are eligible to receive the Infant Supplement directly (and the EPP).

Teen Parent

Includes, under specified circumstances, a child adjudged to be a dependent child or ward of the court or a child who is a ward of a NRLG and receiving case management, living in an out-of-home placement in a WFFH, who is a parent.  Teen Parent also includes a nonminor dependent (NMD) parent, living in out-of-home placement.

  • For eligible parenting NMDs who remain in EFC, the infant supplement for a nondependent child residing with the NMD is still available in all placements, including the SILP and THP NMD placements. Additionally, these parenting NMDs still have the option to remain in, or be placed in, a WFFH which can include the THP NMD host family site.

Transitional Housing Placement for NMD (THP-NMD)

A THP NMD is a transitional housing opportunity where NMDs live in an apartment or house in the community and receive life skills training to help them achieve their EFC goals and to become self-sufficient.  THP NMD provides supportive services.  NMDs may be placed in one of three (3) THP NMD housing models:

  • Host Family: A placement where the NMD lives with a caring adult.
  • Single Site: A placement where the NMD lives alone or with another NMD in THP NMD provider supervised apartments or houses, where the THP NMD provider staff person lives in a separate apartment/house on the same property.
  • Remote Site: A single housing unit where the NMD lives independently and THP NMD provider staff person does not live in the same building. This may include apartments, single family dwellings, or condominiums in various locations, not necessarily near each other.
PROCEDURE

Infant Supplement

Revenue Enhancement Eligibility Workers will not process a rate adjustment for cases that are not properly documented with the Child Welfare Services/Case Management System (CWS/CMS) Special Projects code.

Technical Assistant Eligibility Worker (TA/EW) Responsibilities

  1. Upon receipt of the Auto 280 requesting placement for the dependent parent with an infant supplement take the following steps:
    1. Access the CWS/CMS application and open the existing case.
    2. Review the Special Projects Page set up by the CSW to ensure the correct placement type matches the information on the Auto 280.
      • If the coding is not indicated in the Special Projects Page or it does not match the information on the Auto 280, return the Auto 280 to the CSW for correction/clarification.
        • Refer to Attachment A, Placement Option Scenarios and Corresponding New Rates. 
  2. Select a new row on the Ongoing Request page of the Placement Notebook.
    1. Select the rate that reflects the placement type in the Special Projects Page and in the DCFS 280.
    2. Select Infant Supplement in the Special Care Increment (SCI) Payment Reason type.
    3. Data enter the appropriate SCI amount(s).
  3. Write in the “Reason Description” box one of the following when applicable to the rate requested:
    • Child’s name and DOB
    • IS- Infant Supplement
    • SRP- Shared Responsibility Plan Rate
    • PSP- Parenting Support Plan Rate
  4. Request “pending approval”, save to the Database and notify the ES of the “pending approval.”
  5. Send a Medi-Cal notice to the Medi-Cal unit (MEDS_Referral@dcfs.laounty.gov) to initiate or modify a Medi-Cal benefits card for the child and minor parent. (See Procedural Guide E080-0580, Medi-Cal Benefits).
  6. Record all completed activities in the Case Notes.

  1. Upon receipt of request for approval of the Infant Supplement Rate in CWS/CMS, either approve or return to the TA/EW for correction.

Whole Family Foster Home (WFFH)

Dependent Infant is Placed with Their Dependent Parent in a WFFH or a Resource Family Home (RFH)

Dependent infants may be placed in a WFFH or RFH with their dependent teen or NMD parent, however, the dependent Infant’s Special Projects Code and payment rate will not change. The Infant Supplement and SRP rates are not available for dependent infants.

Parenting Support Plan (PSP) & Rate for SILPs

In the instance when the NMD has more than one infant, in order to get the additional payment for each infant, there must be individual PSP(s) for each child.

Technical Assistant Eligibility Worker (TA/EW) Responsibilities

  1. Upon receipt of an Auto 280 (or PROB 667 from the probation officer) requesting the PSP Rate, with a copy of the approved PSP attached, initiate the PSP rate in CWS/CMS and send to the ES for approval.
    1. Enter the payment to the NMDs case on the Ongoing page with the payment type as “Infant Supplement Family”
    2. Update the Special Projects page to reflect the NMD SILP Non-dependent Infant with the PSP.

Eligibility Supervisor (ES) Responsibilities

  1. Upon receipt of request for approval of the PSP Rate in CWS/CMS, either approve or return to the TA/EW for correction.

Transitional Housing Placement for NMD (THP-NMD)

STATUTES AND OTHER MANDATES

All County Letter (ACL) 06-04, Minor Dependent Parents in Foster Care dated June 20, 2006 - The purpose of this All County Letter (ACL) is to provide information regarding changes made by Senate Bill (SB) 500 (Chapter 630, Statutes of 2005), to the rates paid and placement requirements of infants placed in foster care with their minor dependent parents.

ACL 08-24, Minor Dependent Parents in Foster Care dated June 9, 2008 - The purpose of this All County Letter (ACL) is to provide information regarding changes made by Senate Bill (SB) 720 (Chapter 475, Statutes of 2007) to the rates paid and placement requirements for infants placed in foster care with their minor dependent parents. This legislation makes clarifying changes to statute enacted by SB 500 (Chapter 630, Statutes of 2005) and instructions issued to counties in ACL No. 06-04. The goal of SB 720 is to encourage the joint placement of infants and their teen parents when both are in foster care and to provide the most family-like setting possible.

Penal Code 11170 – Addresses the Child Abuse Central Index (CACI)

Senate Bill (SB) 500 - AFDC-FC: Pregnant and Parenting Foster Youth (2005), which established Whole Family Foster Homes (WFFHs) and Shared Responsibility Plans (SRPs).

WIC 16501.25 – Sets forth the requirements for a viable Shared Responsibility Plan.  Commencing January 1, 2012, "teen parent" also means a nonminor dependent, as defined in subdivision (v) of Section 11400, who is living in a whole family foster home, as defined in subdivision (t) of Section 11400, and is eligible for AFDC-FC or Kin-GAP payments pursuant to Section 11403.
